The conditions below regulate the contracts of sale made between the owner of North World Sim® / NWS® (hereinafter, “the SELLER”) and its customers, from the order and payment process to the effective delivery of the products, including the recognition and procedure for the attention of the rights and responsibilities of both parties.

The use of the electronic commerce platform managed under the commercial name the SELLER is hosted in the domain www.nwssim.com for the commercial offer and processing of sales contracts, requires the express acceptance of these general conditions for the processing of purchase and payment orders, and for the registration of customer account.

Therefore, persons who intend to make use of their functions to acquire the products offered should carefully read the content of the headings in this section, without prejudice to the obligations and responsibilities of the SELLER as a commercial bidder of goods against any Internet user.

The SELLER strives to keep the content of this section updated according to possible modifications and regulatory adaptations, which will always prevail in case of disparity, temporary or permanent, in favor of the user and client, who will have the right to demand the new conditions imposed by any regulatory change and to be informed of the impact that they may have in relation to their ongoing orders or rights derived from the transactions carried out prior to said modifications.

2. Scope of Contracting

The general conditions of purchase apply to the purchase and sale operations and their legal derivations, prior and subsequent, of all the products offered and marketed by the SELLER through the domain www.nwssim.com, accessible to people of legal age and emancipated minors in Spanish and English worldwide.

The e-commerce platform used in the management of purchase and payment orders, and registration of customer accounts makes a record of the time and date on which the general conditions of purchase described in this section have been accepted in both cases.

The SELLER reserves the right to cancel any customer account if it considers that there is a risk of fraud, speculation or bad faith on its part or third parties involved, without this affecting in any way the commercial transactions carried out prior to its cancellation, communicating it in any case and immediately to the interested party for the purposes of data protection regulations and the rights and actions that may correspond to him.

3. Prices

The prices of each product are exposed in its file and throughout the order process, including the corresponding amount of VAT (Value Added Tax).

Shipping costs are shown to the customer in an equally broken down manner throughout the order process based on the order placed and the designated delivery address.

4. Orders

5. Payment

The payment must be made at the end of the purchase process, finalizing it.

The SELLER accepts payments by debit and credit cards, bank transfer and Bizum, which must be made only by persons of legal age.

The SELLER does not accept payments made after the shipment of the order or deferred, such as cash on delivery, drafts or credits in physical store against the delivery of the products ordered.

Once the process is finished, the customer will be able to consult the amount paid through the selected payment method, along with the rest of the contractual information corresponding to the sale made, in your order history available in your customer account on the website, as well as in the information sent by electronic message to your mailbox, and in paper format attached to the product sent to your shipping address or delivered in physical store.

6. Purchase receipt and Billing

Once the purchase process has been completed, the customer will receive an electronic message that will include the following elements:

7. Delivery

The SELLER uses a transport service for the delivery of the products purchased by its customers through its website.

Shipping costs are determined according to the parameters set out in our e-commerce platform based on the purchase made and the destination designated by the buyer.

The delivery is made through the contracted transport services, our international Couriers.

All this without prejudice to the possibility of collecting information on the status of each order through our Customer Service and After-Sales channels.

8. Right of Withdrawal

The right of withdrawal allows the customer to return the product with a full refund of the payment paid within 14 calendar days of receipt without the need to allege justification and at no cost.

The customer will only be responsible for the decrease in value of the products resulting from a manipulation of these different from that necessary to establish their nature, their characteristics or their operation. And in no case will you be responsible for the decrease in value of the goods if the entrepreneur has not informed you of your right of withdrawal.

The SELLER will refund the amount received by the same means used for the payment of the product, including shipping costs to the customer, without any delay and always before 14 calendar days from the notification of the withdrawal decision.

However, the SELLER reserves the right to withhold the refund until receipt of the product or products, or until receipt of proof of return, such as the shipping note of a transport service, depending on which condition is met in the first place.

The customer can expressly provide another means of reimbursement of the payment as long as he does not incur any cost as a result of said refund.

In turn, the customer must return or deliver the products received to the SELLER or to a person authorized to receive them, without any undue delay within 14 calendar days from the date on which he communicates his decision to withdraw from the contract to the SELLER.

The customer may also choose a means of delivery other than the less expensive mode of ordinary delivery, in which case the SELLER shall not be obliged to reimburse his addThe impossibility of returning the product by the customer due to loss, destruction or other cause will not deprive him of the possibility of exercising the right of withdrawal. In these cases, when the impossibility of return is attributable to him, the customer will be responsible for the market value that the product would have had at the time of the exercise of the right of withdrawal, unless said value was higher than the purchase price, in which case he will be responsible for it.

Exception to the Right of Withdrawal

The specialty of our line of products, some of which are made and prepared in a personalized way and according to the client’s indications, is an exception to the right of withdrawal according to the general regulations of consumers and users.

9. Product Availability

In the event of any incident in the supply or availability of products in storage that prevents the fulfillment of an order, the SELLER will proceed to inform the customer of the incident and refund the amount paid for the product not available without delay, and always before the course of 14 calendar days after the order, by the same means of payment used by the customer for his subscription.

9. Warranty

The SELLER fully acknowledges the right of its customers and consumers to ensure the nature, characteristics, conditions and usefulness or purpose of the products purchased; to claim effectively in case of error, defect or deterioration; to make effective the guarantees of quality or level of performance offered, and to obtain the refund of the full amount paid in case of non-compliance or defective compliance.

Therefore, the SELLER acknowledges the right of guarantee with respect to all the products integrated in its offer, assuming the commitment to refund the price paid or replace the delivered product in case of breach of its obligations with respect to the guarantee of conformity.

Guarantee of Conformity

The SELLER undertakes to guarantee the conformity of the products in its commercial offer, taking care to ensure the exact match between the product offered, advertised and labeled, and the one contracted and delivered, in terms of:

a) Description, type, quantity and quality, durability and functionality for which they are normally intended or that the customer can reasonably expect given their nature.

b) Suitability for the specific purposes for which the customer needs them expressed in a particular way at the time of conclusion of the contract, and for which the SELLER has expressed his acceptance.

The SELLER is responsible in the event of lack of conformity of the products delivered before the simple declaration in this regard by the customer demanding the replacement of the product received or the termination of the contract, with return of the product and refund of the full amount paid in one or another case.

Non-Conformity Complaint Procedures

In the absence of conformity with the product received, the customer can opt for the replacement of the product, or for the termination of the contract and return of the product.

Product Replacement

When the replacement of the good is appropriate, the customer will make it available to the SELLER, who will recover the replaced product without inconvenience and free of charge for the customer, paying the costs of collection and transport of the non-conforming product from the place of collection indicated by the customer, and those of delivery of the product in replacement.

The replacement will be carried out within a reasonable time from the moment in which the SELLER has been informed by the customer of the lack of conformity, and always within 14 calendar days after receipt of the notification.

In no case shall the customer be liable for payments or costs for the normal use of the replaced goods during the period prior to their replacement.

Keep in mind that the profiles with which the Cockpits and the rest of the accessories are made, are made of industrial aluminum so they may have some brand, scratch and bump.

So upon receipt by the customer, the goods must be inspected immediately for defects, condition and quality. In case of any apparent defect, it must be informed in writing within 10 days of its discovery, failure to do so within this period of ten days the guarantee of these defects will not apply in any case. The guarantee is 2 years from the receipt of the goods.

Termination of the Contract

In the absence of conformity of the product, the customer can exercise the right to terminate the contract by express declaration of his decision to the SELLER, which generates the reciprocal obligations below:

a) The SELLER will reimburse the customer for the price paid for the product or products without undue delay and, in any case, within 14 calendar days after receipt of these or, where appropriate, proof provided by the customer that he has returned them, such as the sending of a receipt or note of transport service.

b) The customer will return to the SELLER, at the expense of the latter, the product or products received.

c) The SELLER will make the refund, without any additional charge, using the same means of payment used by the customer in the purchase process, unless expressly agreed between the parties otherwise, and provided that it does not involve an additional cost for the customer.

Deadline for Manifestation of Lack of Conformity

The SELLER will be responsible for the lack of conformity that exists at the time of delivery of the product or that manifests itself within a period of two years from delivery.

Unless proven otherwise, it shall be presumed that the lack of conformity that manifests itself in the three years following the delivery of the product or products, already existed when the product was delivered, except when for the products this presumption is incompatible with their nature or the nature of the lack of conformity.

For the proof of delivery of the product, it is understood to be made on the day that appears on the purchase invoice or on the corresponding delivery note if this is later.

In any case, the SELLER will deliver to the customer to exercise his right to bring the product into conformity, either by substitution or termination of the contract, documentary justification on the making available of the product or products by the customer in which the delivery date and the lack of conformity are recorded that originates the exercise of the right, as well as documentary justification of the delivery to the customer of the product already compliant, in which the date of this delivery and the description of the corrective measure carried out are recorded.

11. Modification of Conditions

The SELLER reserves the right to modify these general conditions of purchase at any time to adapt them to any change in the commercial offer provided in its catalog, in its commercial sector or to modifications in the regulations applicable to any of the headings in this section.

In no case, the changes that may be made will affect the rights derived or that could derive from the commercial transactions carried out prior to said modifications.

12. Customer Service and After-Sales

The SELLER guarantees personalized attention before, during and after the process of purchase and delivery of any product through its e-commerce platform.

The SELLER also guarantees the existence of an adequate technical service, as well as spare parts for a minimum period of ten years from the date on which the good ceases to be manufactured, without increasing the prices of the spare parts when applying them to the repairs.

Any query and request for information about the products offered in its catalog or through advertising elements on the Internet will be attended and resolved within 24 hours of receipt, or immediately if it is made by telephone before our Customer Service and After-sales.

Likewise, any claim subsequent to the purchase of a product in exercise of the right of withdrawal or for lack of conformity with will be attended within 24 hours after receipt to initiate the corresponding return and refund process according to the conditions in section 10 of these general conditions of purchase.
